Terms of Service

These terms govern your use of the Simunye platform ("Platform"), operated by Simunye (Pty) Ltd ("we", "us", or "Simunye"). By creating an account, you agree to these terms. If you do not agree, please do not use the Platform. These terms are written in plain English so everyone can understand them.
1. What Simunye Is
Simunye is a membership club for South African consumers. As a member, you get access to:
- Products at cost — everyday products sourced and sold to members at cost price, with no retail markup.
- Simunye Tree — a referral system that rewards you for inviting others.
- Monthly raffle — automatic entry into a monthly prize draw for active members.
- Simunye Wallet — platform credit earned through referrals that can be used on the Platform.
Simunye is not a retail store, investment scheme, pyramid scheme, or financial services provider. It is a membership-based buying club.
2. Membership Plans and Payment
We offer two membership plans:
Monthly
R99/month
Billed monthly. Cancel anytime.
Annual
R989/year
Save over 2 months. Billed yearly.
All prices are in South African Rand (ZAR) and include VAT where applicable. Payments are processed securely by Paystack. Your subscription renews automatically at the end of each billing cycle unless you cancel before the renewal date.
3. Cancellation and Refunds
- You can cancel your membership at any time from your account settings.
- When you cancel, your membership remains active until the end of your current billing period. You will not be charged again.
- Monthly plan: no refund for the current month. You keep access until the end of that month.
- Annual plan: if you cancel within the first 14 days, you may request a full refund. After 14 days, no refund is given, but you keep access until the end of your annual period.
- Refunds are processed back to your original payment method within 5–10 business days.
- We reserve the right to cancel memberships that violate these terms, in which case no refund will be issued.
4. Simunye Tree (Referral Programme)
The Simunye Tree is our referral system. When you invite someone and they become a paying member, you earn rewards:
Tier 1 — Direct Referrals

Rules and limits:
- Referral rewards are capped at R500 per month per member.
- Rewards are credited to your Simunye Wallet, not paid out in cash.
- Both you and the person you refer must be active, paying members for the reward to apply.
- You may not create fake accounts, use bots, or engage in any fraudulent activity to earn referral rewards.
- We reserve the right to adjust the referral structure, reward amounts, or cap at any time with 30 days' notice.
- If a referred member cancels within their first month, the referral reward may be reversed.
5. Monthly Raffle
Every active member is automatically entered into our monthly raffle. Here is how it works:
- Automatic entry — if your membership is active and paid up at the time of the draw, you are entered automatically. No extra steps needed.
- Winner selection — winners are selected randomly using a verifiable random process.
- 6-month cooldown — if you win, you cannot win again for the next 6 months. This gives more members a chance.
- Prizes — the prize for each draw will be announced in advance on the Platform. Prizes cannot be exchanged for cash unless specifically stated.
- Notification — winners will be notified by email and announced on the Platform.
- We reserve the right to modify raffle frequency, prizes, and rules with prior notice to members.
6. Simunye Wallet
Your Simunye Wallet holds platform credit earned through referral rewards and other promotions. Important things to know:
- The Wallet is platform credit only. It is not a bank account, e-money account, or financial product.
- Wallet balance can be used to purchase products on the Platform or to pay for your membership subscription.
- Wallet credits cannot be withdrawn as cash or transferred to a bank account.
- Wallet credits cannot be transferred to another member's account.
- Wallet balance does not earn interest.
- If your membership is cancelled or terminated, any remaining Wallet balance will be forfeited after 90 days.
- We reserve the right to reverse credits that were earned through fraud or abuse.
7. Acceptable Use
When using Simunye, you agree not to:
- Create multiple accounts or use fake identities.
- Use bots, scripts, or automated tools to interact with the Platform.
- Attempt to manipulate the referral system, raffle, or Wallet.
- Share your login credentials with others.
- Resell products purchased through Simunye for commercial profit.
- Post or share content that is harmful, abusive, hateful, or illegal.
- Attempt to reverse-engineer, hack, or disrupt the Platform.
- Misrepresent Simunye as an investment or money-making scheme when referring others.
Violating these rules may result in immediate termination of your account without refund.
8. Limitation of Liability
We work hard to keep Simunye running smoothly, but there are limits to what we can guarantee:
- The Platform is provided "as is". We do not guarantee that it will always be available, error-free, or uninterrupted.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
- Our total liability to you for any claim related to the Platform is limited to the amount you have paid in membership fees in the 12 months before the claim.
- We are not responsible for third-party services such as Paystack payment processing or internet connectivity issues.
- Product availability, pricing, and delivery timelines may change. We will do our best to keep things accurate, but errors can happen.
Nothing in these terms limits your rights under the Consumer Protection Act, 2008, or any other mandatory South African law.
9. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any dispute arising from these terms or your use of the Platform will be subject to the jurisdiction of the South African courts.
Where possible, we will try to resolve any dispute informally before going to court. You can contact us at support@simunye.mobi to raise any concerns.
10. Changes to These Terms
We may update these terms from time to time. When we make material changes, we will notify you at least 30 days in advance via email or an in-app notice. Continuing to use the Platform after the changes take effect means you accept the updated terms. If you do not agree with any changes, you may cancel your membership before the changes take effect.
